VP Assistant General Counsel

The Vice President & Assistant General Counsel (AGC) will report directly to the Chief Legal Officer and be responsible for the strategic oversight and management of the company's general liability (non-employment) and commercial litigation. The AGC will serve as the head of Lowe's General Liability and Commercial litigation team, which contains approximately 16 employees, and handles litigation in a wide range of business areas. In addition to managing outside counsel and the internal team of lawyers and other legal professionals, the AGC also will monitor changes in the law and develop and improve the company's policies and procedures related to handling and resolving litigation matters while meeting business objectives. In addition, the AGC will be responsible for managing the department's General Liability and Commercial Litigation budget and will monitor and measure the department's progress, effectiveness and productivity on such matters while advising business leaders on strategies to reduce litigation exposure consistent with business objectives.

This role will provide practical, business-savvy inter-disciplinary support with respect to a wide range of commercial, consumer, and tort disputes and litigation matters affecting the company. Among the matters that may arise are general commercial disputes; consumer actions and claims; contract disputes; government enforcement inquiries or investigations; intellectual property disputes; construction, real estate, and real property issues; and product's liability, premises liability, and other personal injury, property damage, and tort litigation, among others.

Responsibility Statements:
  • Manage the company’s general liability and commercial litigation matters Manage in–house legal counsel, non-attorney professionals and paraprofessionals
  • Maintain a highly skilled and engaged workforce by aligning resource plans with business objectives
  • Monitor applicable legal and regulatory developments and evaluate their impact on the company’s operations and business plans; achieve best possible results at reasonable costs
  • Work proactively with senior management and business clients to identify potential legal and business risks and work collaboratively with clients and colleagues to build relationships and develop creative solutions for mitigation of those risks
  • Manage and provide direction regarding trends in various litigation categories and guidance to senior business leaders regarding risks and likely outcomes for litigation and pre-litigation matters
  • Recommend practical solutions toward mitigating litigation risk which appropriately balance business needs and facilitate company objectives Identify and retain outside counsel when necessary, and continually evaluate the responsiveness and effectiveness of outside counsel and recommend changes when warranted
  • Develop and maintain key strategic, external relationships through involvement in industry groups that bring value to the company
  • Measure Litigation Practice Group progress, effectiveness, efficiency and productivity by utilizing relevant benchmarking measures and analytical tools
  • Assist in other substantive legal areas as needed
  • Coach, mentor, develop, and manage a team of legal professionals
  • Work as part of a team with other company Assistant and Associate General Counsel, and the Chief Legal Officer, to lead the company’s Legal Department in meeting the company’s changing needs
  • Work across various company brands, business units, lines of business, and affiliated companies in providing legal support

Requirements:

  • Bachelor's Degree & Juris Doctor from an accredited law school and membership, in good standing, of at least one (1) U.S. State Bar Association
  • 12+ years of experience in a law firm or a mixture of relevant experience in a law firm and corporate legal department
  • 5+ years of direct legal experience with public companies, including working with processes and procedures applicable to public companies 5+ years of leadership experience managing a team of attorneys
  • 5+ years of experience working closely with senior corporate leadership
  • 2+ years of experience working in a matrix environment, with preferred experience in a multi-channel, multi-brand, or affiliated companies
  • 2+ years of experience helping to develop and direct a company litigation strategy
  • 2+ years of experience participating in managing a team through a corporate or firm change initiative
